THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10578 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.116 of 2023 on the file of Thimmajipet Police Station, Nagarkurnool District, registered for the offence under Section 304 (B) r/w. 34 of IPC. 2.
Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The father of the deceased, who is the father-in-law of this petitioner/A-1 filed the present complaint stating that he got his daughter married to A-1 on 11.05.2023. At the time of marriage, dowry was given. Two months prior to her daughter's death, this petitioner and his parents harassed the deceased saying that she was not bearing children. Further, they were also stating that she was sitting idle in the house without doing any work. Number of times, the de-facto complainant requested A-1 saying that he would arrange for additional dowry and requested to look after the deceased properly. However, call was received on 30.08.2023 stating that the deceased committed suicide by handing herself.

As seen from the allegations, the allegation of not bearing children appears to be highly improbable. Though there is an allegation of demand of additional dowry, no specific details are given as to what was demanded when the said demand was made. In cases of death, there is a likelihood of near and dear of the deceased implicating the husband in the case. 5.
However, keeping in view that the petitioner is in jail since 27.09.2023 and as seen from the remand report, major part of the investigation is complete, the prayer for regular bail can be considered, subject to following conditions:- i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of I Additional Judicial Magistrate of First Class-Cum-Special Mobile Court at Nagarkurnool. ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer, on every Monday at 10:00 a.m., for a period of eight weeks for the purpose of investigation and thereafter, as and when required.
iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
