This Writ Petition is filed challenging the proposal of the Sarpanch, Muthkur Grampanchayat, Muthukur Mandal, SPSR District and the consequential Proceedings dt. 01.02.2002. In the entire affidavit, no date was given with regard to resolution passed by the Gram Panchayat. But, a perusal of the consequential proceedings dt. 01.02.2002 show that the land of an extent of Ac.5.90 cents was sought to be resumed for construction of mini stadium as the land was kept waste.

It is submitted by the learned counsel for the petitioners that challenging the resumption proceedings dt.01.02.2002, an appeal was preferred before the Joint Collector and the same is pending. The instructions of the learned Government Pleader disclose that there was a proposal for construction of mini stadium at Muthukur Village and an extent of Ac.9.50 cents was handed over to the District Sports Development Officer & Secretary, District Sports Authority, Nellore, by Proceedings Dt. 01.11.2002. Out of the total extent of land, an extent of Ac.3.60 cents was handed over to the Sports Authority after initial handing over of Ac.5.90 cents of Government Land.

This Court cannot examine the alleged proposal of the Sarpanch, Muthkur Gram Panchayat, Muthukur, which has taken place about 15 years back. If the petitioners have any right with

ARLR,J WP_28526_2017 regard to the property claimed by him, which was later on resumed, it is open to the petitioners to agitate their rights in the pending appeal.

Accordingly, this Writ Petition is dismissed. As a sequel, miscellaneous petitions, if any, pending in this case, shall stand closed.
