- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.29104 OF 2019 ORDER :

Heard learned counsel for the petitioner and learned Government Pleader for Revenue for respondents. 2.

Petitioner contends that his father and two others namely Vangala Ramaiah and Gangara Boina Narasaiah, were granted 38-E Certificated to an extent of Ac.31.34 Guntas in Sy.Nos.102 and 103 of Hanmanthpur, Narmetta, Jangaon District. Petitioner now alleges that there is no individual demarcation of the respective extents of land, between the three 38-E certificate holders, leading to lot of difficulties in enjoying the properties. Therefore, petitioner wants a survey to be conducted and demarcation of the lands respectively. Along with the writ petition, several representations stated to have been filed are enclosed. 3.

From a reading of the representation, no where the request to conduct survey and demarcation, was made, even assuming that the same is permissible, when there is no division of property, jointly held by three persons. On the contrary, petitioner requests the Tahsildar to undertake division of property standing in the name of three persons, jointly held by them. No such relief as sought for can be granted in this writ petition. 4.

Thus, leaving it open to the petitioner to work out his remedies, as available in law, the Writ Petition is dismissed. Pending miscellaneous petitions, if any, shall stand closed. __________________ P.NAVEEN RAO,J 31st December, 2019 Rds
