Bhaskar Nagar Colony Development, v. State Of Ap., Rep By Secretary(Municipal Administration),
THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE T.RAJANI Writ Petition No.16025 of 2008 ORDER: (Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan) Neither is Sri M.Sivananda Kumar, learned counsel for petitioner, present nor is there is any representation on his behalf. By way of an amendment to the writ petition, the validity of Ordinance No.15 of 2007 issued under G.O.Ms.No.901, Municipal Administration and Urban Development, dated 31.12.2007 was questioned.
Both the learned Government Pleader for Municipal Administration and Sri A.Panduranga Rao, learned Standing Counsel for the Rajahmundry Municipal Corporation, would state that the said Ordinance was subsequently replaced by an Act and, consequently, the cause in the writ petition does not survive necessitating any further adjudication by this Court.
The Writ Petition is, accordingly, dismissed as infructuous. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
