THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.5095 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner questions the resumption order dated 23.12.2015, Ex.P1, issued by the Tahsildar, Gajwel Mandal, Medak District, the 3rd respondent. However, under the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977, the petitioner has an efficacious alternative remedy of questioning the impugned order in an appeal before the competent authority and he is also entitled to seek interim relief therein. However, without availing the said remedy, the petitioner has straight away filed the present Writ Petition. Hence, there is no reason to entertain the Writ Petition.

The Writ Petition is accordingly dismissed giving liberty to the petitioner to avail the appropriate remedy in accordance with law. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
