Seeking the Court to enlarge the petitioner, who arrayed as accused in Crime No.605 of 2025 of Bachupally Police Station, Cyberabad Commissionerate, on bail, the present petition is filed. 2 .
The brief facts of the case are that, on 21.06.2025, the SubInspector of Police received credible information about a person in possession of counterfeit currency near Nizampet Arch.
Immediately, he conducted raid and they observed a suspicious individual carrying a rexine bag, who attempted to flee upon seeing the police. He was apprehended, and upon physical inspection, fake Rs.500/- currency notes were found in his bag. The accused was taken into custody and, during interrogation, admitted the notes were counterfeit and he revealed that accused No.2 is the organizer of the fake currency notes. The police recorded his confessional statement and seized One rexine bag containing 6 bundles of Rs.500/- counterfeit notes totaling Rs.15,00,000/- lakhs and one mobile phone. Basing on the same, the Police registered a case vide Crime No.605 of 2025 for the offences punishable under Sections 318(4), 178, 179 and 180 read with 3(5) of BNS.

Heard Sri P. Krishnakanth, learned counsel appearing for the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the petitioner was innocent of the alleged offences and had been arrested on 21.06.2025, remaining in custody since then. He further submitted that all material witnesses had been examined and that further detention of the petitioner was unnecessary, particularly as no charge sheet had been filed by the Investigating Officer. Therefore, prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner were grave in nature, as he had been found in possession of Rs.15,00,000/- in counterfeit currency notes. It was further submitted that the investigation was still ongoing and that Accused No.2 remained absconding, releasing the petitioner on bail at this stage may lead to tampering with evidence or intimidation of witnesses and prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it was evident that the sole allegation against the petitioner was that he had been in possession of a large quantity of counterfeit currency notes. The petitioner had been in judicial custody since 21.06.2025, and a substantial part of the investigation had already been completed. As informed by the learned Additional Public Prosecutor, no charge sheet had been filed as of that date, and there were no criminal antecedents against the petitioner. Therefore, this Court deemed it fit to grant bail to the petitioner, subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned XI Additional Metropolitan Magistrate, Kukatpally, Medchal-Malkajgiri District.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.
(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
