HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.23002 of 2015 ORDER:

Heard.

The eviction order, dated 17-07-2015 passed by the 4th respondent is questioned in this writ petition.

Undoubtedly, the said order is an appealable and in fact on earlier occasion, when the order of eviction was passed against the petitioner similarly, he has filed an appeal before the 3rd respondent and the same was allowed and the matter was remanded to the 4th respondent for fresh consideration and passing appropriate orders. The 4th respondent appears to have given a fresh notice and the petitioner filed explanation and thereby, the present impugned order is passed.

I, therefore, see no reason why the petitioner cannot invoke the appellate remedy and seek appropriate orders from the appellate authority. Accordingly, the writ petition is disposed of with the liberty as stated above. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
