THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CIVIL REVISION PETITION No.2761 of 2015 ORDER:

The plaintiff in the suit is the petitioner in this revision. The respondent Nos.1 to 6/defendants have filed I.A.No.366 of 2014 in the suit under Order 8 Rule 1 (1-A)

(3) of C.P.C. seeking receipt of a document said to have been furnished by a person in-charge of a burial ground.

I fail to understand as to how the certificate produced by the defendants would cause any prejudice to the plaintiff/petitioner for establishing her case. I, therefore, do not see any justifiable reason to entertain this revision and it is, accordingly, dismissed. No costs.

However, it goes without saying that mere receipt of a particular document at the hands of the defendants does not mean that the cause of the plaintiff cannot be held established by any other method and that the plaintiff cannot discredit or disprove the contents of any particular document.
