HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10451 OF 2017 ORDER:

The seizure of tipper bearing No.AP 16 X 0747 on 27.02.2017 is challenged before this Court.

It is contention of the learned Counsel for the petitioner that no notice, whatsoever, was issued to the petitioner; and, at any rate, petitioner is not using sand for commercial purposes and is only a transporter eking livelihood on transportation.

When the matter is taken up, learned Government Pleader for Mines and Geology placed before this Court notice dated 20.03.2017 issued to the petitioner calling for explanation and no explanation has been submitted as on date.

Considering the fact that notice has already been issued to the petitioner, liberty is given to submit his explanation to respondent No.2, which shall be considered within a period of one week, from the date of submission of explanation, and pass appropriate orders, in accordance with law.

The Writ Petition is, accordingly, disposed of. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
