THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 14792 OF 2010 O R D E R :

This writ petition is filed challenging the order dt.12.02.2010 in F.No.89-1343/2009-Appeal A10621 on the file of 1st respondent and the proceedings dt.06.10.2008 in F.SRO/NCTE/Ref/2008-09/5862, on the file of the 2nd respondent.

Learned Counsel for the petitioner submits that neither the original authority nor the appellate authority has considered the objections raised by the petitioner in proper perspective; and that the order of the appellate authority is bereft of reasons. He also submits that when the petitioner filed WP.No.21826 of 2012 challenging the action of the respondents in not taking any action on the application of the petitioner for recognition in respect of new building, the same was allowed observing that pendency of this writ petition cannot come in the way of respondents from making inspection and considering the application. He also states that in pursuance to the direction in WP.No.

21826 of 2012, the respondent authorities have considered the application of the petitioner and granted temporary recognition subject to orders in this writ petition. It is to be seen that petitioner has shifted the institution to new premises. So, the lis in this writ petition no longer survives because the deficiencies that are pointed out by the respondent authorities are in respect of old premises in which the petitioner is no more running.

not required to be remanded because the petitioner is not operating the institution in the old premises which is the subject matter of this writ petition.

In view of the above, the writ petition is allowed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
