HON'BLE DR. JUSTICE B. SIVA SANKARA RAO Transfer Criminal Petition No. 173 of 2017 ORDER:

A perusal of the prayer shows that O.P.No.251 of 2017 is pending on the file of Hon'ble Judge, Family Court, Warangal, for restitution of conjugal rights under Section 9 of Hindu Marriage Act, 1955. However, this petition is filed under Section 407 Cr.P.C instead of invoking Section 24 C.P.C.

2) Having regard to the above, the Transfer Criminal Petition is disposed of for nothing to adjudicate on merits but for to observe that remedy of petitioner is elsewhere to invoke. 3) Pending miscellaneous petitions, if any, shall stand closed.
