THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.30630 of 2016 ORDER:

This writ petition is filed seeking a writ of Mandamus declaring the inaction on the part of the respondents 2 to 6 herein to dispose of the representation of the petitioner dated 11.07.2016 as illegal and arbitrary.

Heard the learned counsel for the petitioner, the learned Government Pleader, representing the respondents 1 to 3 and the learned Government Pleader for Fisheries, representing the respondents 4 and 5.

The petitioner is the president of Thimadam Village Fishermen Cooperative Society. A perusal of the record reveals that on 30.03.2016, the fourth respondent granted fishing rights in favour of the petitioner-society. The grievance of the petitioner is that the son of the Sarpanch is not allowing the petitioner to enter into the tank. A perusal of the record reveals that the petitioner herein submitted a representation to the second respondent by marking a copy to respondents 3 to 5.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the second respondent to dispose of the representation of the petitioner dated 11.07.2016. The learned Assistant Government Pleader submitted that instead of approaching the officials, the petitioner filed the present writ petition.

In view of the submissions made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Having regard to the submissions made by both the counsel, the second respondent is hereby directed to dispose of the representation of the petitioner dated 11.07.2016 as expeditiously as possible, preferably, within a period of six weeks from the date of receipt of copy of this order. No order as to costs. As a sequel, the miscellaneous petitions, pending if any in this writ petition, shall stand closed.
