HON'BLE SMT JUSTICE ANIS A.S.M.P.No.1625 OF 2017 AND APPEAL SUIT No.342 of 2012 COMMON JUDGMENT:
A.S.M.P.No.1625 of 2017 is filed by the petitionerplaintiff along with Memorandum of compromise to record the compromise entered into between the parties in respect of the subject matter of the appeal by modifying the decree of trial Court dated 10.02.2012 in O.S.No.166 of 2007 by partly allowing the appeal in terms of the compromise. Appellants, plaintiff and defendant No.2 are present and their respective counsels are also present.
The contents of the compromise are read over to both the parties. Both the parties have agreed that the said contents are true and correct and they agreed voluntarily for the compromise as per the terms and conditions of the Memorandum of compromise.
Therefore, in view of the compromise entered into between the parties, A.S.M.P. No.1625 of 2017 is allowed. Accordingly, the Appeal Suit is partly allowed in terms of the Memorandum of compromise. However, it is made clear that this compromise relates only to the subject matter of suit and appeal. No order as to costs.
Miscellaneous Petitions, if any, pending in this Appeal Suit shall stand closed.
