This writ petition is filed seeking the following - "....to issue a writ or order or direction, especially one in the nature of Writ of Mandamus: i). declare the inaction on the part of the 2nd and 3rd respondent in not concluding the enquiry initiated in terms of show cause Notice No.K/2884/2008 dt.10.9.2008 issued by the 3rd respondent as illegal, and arbitrary. ii). consequently direct the respondents to conclude the enquiry, duly affording opportunity to the petitioner. iii. and pass...."

Though the writ petition is of the year 2009 no counter affidavit has been filed opposing the averments made in the writ petition, and no interim order has been passed by this Court in favour of the petitioner. In as much as the prayer itself is to conclude the enquiry initiated against the petitioner, I deem it appropriate to allow the writ petition directing the respondents to complete the enquiry initiated against the petitioner within a time frame.

Accordingly, the writ petition is allowed with a direction to the respondents to complete the enquiry initiated against the petitioner, if it is not already completed, within a period of three months from the date of receipt of a copy of this order and pass appropriate final orders in accordance with law.

As a sequel, pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
