THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2120 OF 2006 ORDER:
This Criminal Revision Case is filed by the petitioner/respondent challenging the order, dated 3.10.2006, in M.C.No.165 of 2005 on the file of the Additional Metropolitan Sessions Judge for the trial of Jubilee Hills Car Bomb Blast Case-cumAdditional Family Court, Hyderabad.
2. Respondent Nos.1 to 4 are the wife, daughter and sons of the petitioner respectively. They filed M.C.No.165 of 2005 before the Court below seeking maintenance of Rs.1,500/- per month each and the same was partly allowed awarding an amount of Rs.600/- per month each. Aggrieved by the same, the petitioner filed the present Revision Case.
3. Heard and perused the material available on record.
4. The admitted facts are that the petitioner and respondent No.1 are husband and wife and respondent Nos.2 to 4 are the children born to them during their wedlock. Respondent No.1 is living separately along with her children and further, she is not in a position to maintain them. The learned trial Judge, taking into consideration of all these facts, directed the petitioner to pay an amount of Rs.600/- per month each to respondent Nos.1 to 4.
Considering the facts and circumstances of the case, this Court is of the view that the impugned order does not suffer from any infirmity or illegality and the same is in accordance with law. Therefore, the impugned order does not warrant interference of this Court. Hence, the Criminal Revision Case fails and is liable to be dismissed.
5. Accordingly, the Criminal Revision Case is dismissed.
6. Miscellaneous petitions pending, if any, in this Criminal Revision Case shall stand closed.
