HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.7962 OF 2010 ORDER:

The relief sought for in this Writ Petition is for a mandamus to direct the respondents to conduct a survey of the lands in survey No.317 to 320 of Turkayamjal village, Hayathnagar Mandal, R.R. District admeasuring 7 acres belonging to the petitioners, and to fix the boundaries by fixing the date of survey.

The petitioners' grievance is that, though the petitioners had made an application for demarcation of Sy. Nos.317 to 320, the first respondent, after issuing notices, had fixed the date of survey as 27.01.2010; however, on that day, no survey was conducted; and despite legal notice being issued thereafter no action was taken. While the Writ Petition was admitted on 09.04.2010, no interim relief was granted. As more than seven years have elapsed, suffice it to dispose of the Writ Petition permitting the petitioners to make an application, along with the prescribed fee, to the first respondent, if they so choose, to conduct a survey and, on such an application being made, the first respondent shall consider their request for survey in accordance with law. The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. No costs.
