THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.25746 of 2018 ORDER:
The order, passed by the Commissioner, Prohibition & Excise, Nampally-second respondent herein, in appeal filed by the petitioner herein against the order of the Deputy Commissioner, Prohibition & Excise, Karimnagar-third respondent herein, dated 17.02.2018, is under challenge in the present Writ Petition.
Vide order, dated 17.02.2018, the Deputy Commissioner of Prohibition & Excise, Karimnagar-third respondent herein, in exercise of the powers conferred by Section 46 (2) of the Telangana State Excise Act, 1968 (for brevity, 'the Act'), ordered confiscation of the subject vehicle along with the contraband. Aggrieved by the said order, petitioner herein preferred statutory appeal under Section 63 of the Act, before the Commissioner of Prohibition & Excisesecond respondent, and the second respondent herein dismissed the said appeal, upholding the order passed by the primary authority.
As per the provisions of Section 64 of the Act, and statutory revision lies to the State Government against the impugned order. In view of the same, this Court is not inclined to entertain the present Writ Petition. Accordingly, Writ Petition is dismissed, keeping it open for the petitioner to file revision before the State Government,
within a period of two weeks from the date of receipt of a copy of this order, and, if any such revision is filed, the same be considered and appropriate orders be passed within a period of four weeks thereafter. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
