HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1852 OF 2017 ORDER:

The case of the petitioners is that petitioners are absolute owners and possessors of the land admeasuring Ac.1.46 cents, out of Ac.16.72 cents in R.S.No.724, situated at Nandigama, Krishna District having purchased the same through registered sale deed Nos.1962/2014 and 1963/2014 dated 19.06.2014. The petitioners' vendors have purchased the said land through registered sale deed No.1484/2005, dated 06.05.2005, their vendors purchased the said land through registered sale deed No.108/1996, dated 24.01.1996 and their vendors purchased through registered sale deed No.4588/1976, dated 26.08.1976. While so, when petitioners intended to sell the subject land, the 5th respondent informed them that the land in R.S.No.724 belongs to Sri Ramalingeswara Swamy temple, Nandigama.

But as per the list of properties of the temple furnished by the 6th respondent, R.S.No.724 is not included in the list of prohibited properties for registration and is contrary to the list furnished by the 5th respondent. In respect of their claim, the petitioners submitted a representation dated 15.10.2016 to the respondents including the 7th respondent, who is the competent authority to delete subject property from the list of prohibited properties. In pursuant to the same, the 3rd respondent addressed a letter dated 30.10.2016 to the 6th respondent for submission of report. But the respondents failed to initiate any action. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioners, learned Assistant Government Pleader for Revenue, learned Assistant Government Pleader for Endowments and Smt K.Lalitha, learned Standing counsel for 6th respondent.

It is stated that in view of the Full Bench judgment of this Court reported in Vinjamuri Rajagopala Chary and others vs. State of Andhra Pradesh rep. by Principal Secretary, Revenue Department, Hyderabad and others1 , the 7th respondent is the competent authority to take action on the representation submitted by the petitioners.

In view of the same, the 7th respondent is directed to dispose of the representation submitted by the petitioners on 15.10.2016 in terms of the aforesaid Full Bench Judgment and take action accordingly, within a period of three (03) months from the date of receipt of copy of this order. There shall be no order as to costs.
