THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 30140 OF 2014 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader appearing for respondent Nos. 1 to 3. 2.

The prayer sought in the Writ Petition is as under: " ....to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring action of the respondents more particularly the action of the Respondent No. 4 in interfering in the civil disputes at the behest of the Respondents Nos. 5 to 7 herein as being illegal, arbitrary, colourable exercise of power and violative of articles 14, 19 and 21 of the Constitution of India and consequently direct the respondents more particularly Respondent No. 4 not to either harass the Petitioners or interfere in civil disputes at the instance of Respondents Nos. 5 to 7 herein and consequently also to direct the 3rd Respondent herein to take action on the complaint dated 19.9.2014 in the interest of justice."

Learned GP placed on record, the written instructions dated 13.10.2014 issued by the Station House Officer, LMD Colony, Thimmapur Mandal P.S., Karimnagar district.

From the perusal of the said written instructions, it is revealed that on 20.9.2014, petitioner No.3 approached respondent No.3 police station and made a complaint stating that they entered into an advertising agreement with HMTV for promoting their company products of the new venture at Rama Krishna Colony, which was subsequently cancelled, due to which, some disputes arose between them with regard to payment of bills. However on 6.9.2014, at about 10.30 hours, one Ashok Kumar and others came to the office of the petitioners and took away two cheques dated 20.9.2014 for an amount of Rs.10,00,000/ - and Rs.4,50,000/ - from their

Manager Suresh and they are threatening them over telephone. The said complaint was entered in the general diary on 20.9.2014 itself and receipt No.60 was issued to petitioner No.3. As the contents of the complaint comes under the ambit of Section 507 IPC, which is a non cognizable offence, a requisition was made before the learned Additional Judicial First Class Magistrate, Karimnagar to accord permission to register a case. However, orders are awaited. As soon as orders are received from the learned Magistrate, necessary action will be taken. It is also specifically stated that respondent Nos. 2 and 3 have nothing to do with the allegations made in the affidavit and the disputes pending between the petitioners and unofficial respondents. 5.

Taking into consideration the said statement, this Court is of the opinion that no further orders are required in the Writ Petition. 6.

The said written instructions are made part of the record. 7.

Accordingly, the Writ Petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
