THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.3707 OF 2016 O R D E R :

Heard counsel for the petitioner and the Government Pleader for Civil Supplies for respondents.

2. In this Writ Petition, petitioner assails order dt.20.01.2016 of the 2nd respondent suspending petitioner's Fair Price Shop Dealership authorization pursuant to a show cause notice issued to the petitioner on the same day.

3. Petitioner contends that he submitted an explanation to the said show cause notice on 29.01.2016 to the 2nd respondent but the 2nd respondent is not passing any orders thereon.

4. Although counsel for the petitioner contends that the allegations leveled against the petitioner are not true and that no enquiry under the A.P. State Public Distribution (Control) Order, 2008 (for short 'Control Order') is warranted against the petitioner, I am of the opinion that the truth or otherwise of the allegations can only be decided in such an enquiry. Therefore, I am not inclined to entertain the Writ Petition.

5. However, the Revenue Divisional Officer, Karimnagar Division, Karimnagar, who is impleaded as 2nd respondent vide order dt.10.02.2016 in WP.MP.5474 of 2016, is directed to conduct enquiry as per the above Control Order, after giving a personal hearing to the petitioner and pass appropriate orders on or before 20.04.2016.

6. The Writ Petition is disposed of accordingly. There shall be no order as to costs.

7. Consequently, Miscellaneous Petitions pending if any, shall stand

closed.
