THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3155 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused No.7 seeking to quash the proceedings against them in Crime No.78 of 2015 on the file of Central Crime Station, Hyderabad. The petitioner is alleged to have committed the offences punishable under Sections 120(b), 406, 420, 324, 354, 365 and 509 IPC. The allegations against the petitioner are that he is doing Ad business and he induced the de facto complainant to invest money in his business and promised to pay the said amount with interest at 3% and also give him 15% extra irrespective of profit or loss in the business. Believing his words, the de facto complainant invested huge amount and after receiving the same, the petitioner closed his business and escaped.

Learned counsel for the petitioner submitted that the de facto complainant stated in the complaint that accused Nos.1 to 6 and 8, who are common friends of the de facto complainant and the petitioner and through whom he got acquaintance with the petitioner, kidnapped him and obtained signatures on blank cheques, white papers and nonjudicial stamp papers of Rs.100/-, by threatening him that they also paid money to the petitioner in the presence of the de facto complainant, and therefore, he is responsible for the said amount since the petitioner promised the him to give 15% extra in the profits and the wife of the de facto complainant also lodged a complainant against A1 alleging that he kidnapped her husband.

The grounds raised by the learned counsel for the petitioner are to be investigated into by the investigating agency. Therefore, this Court is not inclined to interfere with the investigation against the

petitioner the above crime, at the threshold. Accordingly, the Criminal Petition is dismissed. However, the petitioner is at liberty to challenge the charge sheet filed by the investigating agency for appropriate relief.
