THE HONOURABLE SRI JUSTICE K.LAKSHMAN CRIMINAL PETITION No.9690 OF 2021 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/Accused No.7 for grant of anticipatory bail in the event of his arrest in connection with Crime No.216 2021 of Kamalapur Police Station, Warangal District, registered for the offences punishable under Sections 505 and 509 read with 34 I.P.C. 2.

Heard learned counsel for the petitioner/Accused No.7 and the learned Additional Public Prosecutor representing the respondent/State. Perused the record.

In the complaint, dated 29.10.2021, the allegation against the petitioner/accused No.7 is that Accused No.1 has sent a Whatsup message in the group saying that the M.L.A is having illegal affairs with the wife of the de facto complainant. The petitioner is the admin of said Whatsup group. Except that there is no other allegation against the petitioner herein. 4.

Learned Public Prosecutor, on instructions, would submit that the police have already arrested A.2 to A.5 and they were on bail. This Court, vide order, dated 06.12.2021, in Crl.P.No.8847 of 2021 granted anticipatory bail to accused No.6. 5.

Considering the said facts, this Court is inclined to grant anticipatory bail to the petitioner/accused No.7.

Accordingly, the Criminal Petition is allowed and the petitioner - Accused No.7 is granted anticipatory bail on the following conditions:

i) The petitioner - accused No.7 is directed to surrender before the Station House Officer, Kamalapur Police Station, Warangal District, within a period of fifteen (15) days from today, and on such surrender, the Station House Officer, Kamalapur Police Station, Warangal District, shall release the petitioner on bail on his executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer.

ii) The petitioner - accused No.7 shall abide by the conditions stipulated in Section 438 (2) of Cr.P.C and cooperate with the Investigating Officer in investigating the crime. Miscellaneous petitions, if any, shall stand closed. ________________________ JUSTICE K.LAKSHMAN 24th December, 2021 YVL
