THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 8623 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/A1 & A2 in connection with Crime No.332 of 2019 on the file of Panjagutta Police Station, Hyderabad, registered for the offences punishable under Section 306 of the Indian Penal Code. 2.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The petitioners are arrayed as accused for abetting suicide of the victim. The victim committed suicide by going in front of a moving train on 16.02.2008. A complaint was lodged thereafter. 4.

As seen from the contents of FIR, these petitioners were due to an amount of Rs.1 crore to the deceased. Though several times, the deceased requested the petitioners to pay, these petitioners failed to pay the said amount. Even as per the complaint, these petitioners were due to the deceased and failed to repay.

In the said circumstances, prima facie at this stage it cannot be said that non-payment of the amount due would amount to abetting suicide. These petitioners were not arrested for the past three years and it is not the case that these persons are absconding.

In view of the above, these petitioners can be granted the relief of anticipatory bail in the event of their arrest, subject to the following conditions:

1) The petitioners/A1 & A2 are directed to surrender before the Station House Officer, Panjagutta Police Station, Hyderabad, on 30.09.2022 and on such surrender, the said Station House Officer shall release the petitioners/A1 & A2 on bail, on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/A1 & A2 shall continue to appear before the concerned Station House Officer, on 1st, 6th, 7th, 10th, 11th, 12th, 13th, 14th, 17th, 18th, 19th and 20th from 10.00 A.M to 2.00 P.M and thereafter as and when required, for the purpose of investigation.

3) The petitioners/A1 & A2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
