HON'BLE SRI JUSTICE S.V. BHATT W.P. No.25747 OF 2018 ORDER:

The petitioner challenges notice dated 09.07.2018 as illegal and amounts to issuing fresh notice in respect of the same subject matter when the earlier notice issued on 21.06.2018 is still pending before the respondents.

The Assistant Government Pleader, on instructions, submits that the notice impugned in the writ petition is not fresh enquiry. The 3rd respondent on the earlier occasion accepted the request of petitioner for adjournment and the notice impugned in the writ petition is issued informing the next date of hearing as 26.07.2018. The statement of Assistant Government Pleader is placed on record and the writ petition is dismissed accordingly. No order as to costs.
