THE COURT MADE THE FOLLOWING:
ORDER:
This writ petition is filed for a Mandamus to declare the seizure of the lorry bearing No.AP 30V 9813 along with 105 Qtls. of rice on 16.2.2012, by respondent No.1, as null and void. At the hearing, there is no representation for the petitioners. The learned Assistant Government Pleader for Civil Supplies (AP) submitted that in pursuance of the interim order dt.5.3.2012 both the lorry as well as the seized stocks were released to the petitioners. However, he is unable to state whether the proceedings under Section 6-A of the Essential Commodities Act, 1955 are pending or the same are disposed of. The absence of this information shall not, however, detain this writ petition because of its pendency for more than three years. If the proceedings under Section 6-A of the Act have not been concluded so far, respondent No.
2 is directed to conclude the same and pass a final order and communicate the same to the petitioners within two months from the date of receipt of this order. Release of the lorry and the rice shall be subject to the result of the said proceedings. Subject to the above directions, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P. No.7521 of 2012 shall stand disposed of as infructuous.
