THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.23944 OF 2007 ORDER:

This writ petition is filed seeking to declare the notification dated 19.6.2007 issued by the 1st respondent under Section 4(1) of the Land Acquisition Act proposing to acquire the land of the petitioner as illegal, arbitrary and violative of principles of natural justice, and consequently to set aside the same.

Heard Sri K. Venkatesh, learned Counsel for the petitioner and the learned Government Pleader for Land Acquisition appearing for the respondents.

It has been submitted by the learned Counsel for the petitioner that the notification impugned was issued proposing to acquire the land of the petitioner for the purpose of allotting house sites to the weaker sections under Indiramma Programme, even though alternative land is available. 4.

The learned Government Pleader on written instructions dated 13.3.2018 submitted that the respondents do not intend to acquire the land of the petitioner, and if they intend to acquire the subject land in future, fresh land acquisition proceedings will be initiated. 5.

In view of the above submission made by the learned Government Pleader, the notification impugned can be set aside insofar as the land of the petitioner is concerned.

Accordingly, the Writ Petition is allowed setting aside the notification impugned dated 19.6.2007 insofar as the land of the petitioner

is concerned. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
