THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4037 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.106 of 2015 on the file of Munagapaka Police Station, Visakhapatnam District, registered for the offence punishable under Section 306 IPC.

Heard and perused the material available on record. It is alleged that the husband of the 2nd respondent, who took construction work of three floor building from the petitioner, used to inform the 2nd respondent that the petitioner has to pay Rs.8 lakhs towards labour and building material charges. But he refused to give the said amount and used to quarrel with him and demanded him to complete the work or else he will foist a case under SCs & STs Act against him. On 26.11.2015 the husband of the 2nd respondent came to house and committed suicide.

Learned Counsel for the petitioner submitted that the contents in the complaint do not disclose any ingredients of Section 306 IPC and the petitioner was falsely implicated in the above crime. It was brought to the notice of this Court that the petitioner was released on bail.

Considering the facts and circumstances of the case and the allegations made in the complaint, this Court is not inclined to grant the relief sought by the petitioner. However, the petitioner is directed to approach this Court, if any charge sheet is filed against him on the basis of the present complaint.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________________ JUSTICE RAJA ELANGO Date : 23.3.2016 Nn
