THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10074 of 2015 ORDER:
This criminal petition is filed by the petitioners - Accused Nos.1 and 2 under Section 438 of Criminal Procedure Code seeking to grant bail in Crime No.196 of 2015 on the file of Burgampahad Police Station, Khammam District, registered for the offences punishable under Sections 452, 324, 506 and 290 read with 34 IPC. Heard and perused the material available on record. The case of the prosecution is that they both attacked the de facto complainant and his brother with sticks and caused injuries to them, with regard to a financial dispute.
A reading of the record discloses that the matter arises out of a financial dispute and the allegations against the petitioners are not so serious in nature. Considering the facts and circumstances of the case, this Court inclined to grant anticipatory bail to the petitioners.
In the circumstances, the petitioners - A1 and A2 are directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender they shall be enlarged on bail on their executing personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the said Magistrate. The petitioners are further directed to report before the Station House Officer concerned, as and when required.
