HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.5200 of 2017 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Home for respondents 1 to 3 and even most of the unofficial respondents served, failed to attend, taken as heard and perused the prayer in the writ petition with the supporting affidavit and written instructions on behalf of the respondents submitted to the Court dated 16.03.2017. It is the supporting affidavit averment that police are not properly investigating the case and they are at the instance of the unofficial respondents.

The written instructions received indicate that not only the present crime covered by crime No.163/2016, but also another crime No.81/2014 pending of which in crime No.81/2014 charge sheet is filed. So far as the present crime is concerned, it is mostly completed and final report to be filed soon.

Having regard to the above, the Writ Petition is disposed of, if not any final report filed so far by intimation to the defacto complainant, to file at any cost within two (2) months from today by supplying copy to the defacto complainant by written intimation, so that the petitioner can pursue any protest thereon. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
