THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No.9700 of 2021 ORDER:

The petitioner/A-1 filed the present Criminal Petition under Sections 437 and 439 of the Code of Criminal Procedure seeking to enlarge him on bail in connection with Cr.No.366 of 2021 pending on the file of Nalgonda II Town Police Station, Nalgonda district, which was registered for the offence punishable under Section 20(b)(ii)(C) of N.D.P.S. Act, 1985 r/w Sec.9 of NDPS (Amendment) Act, 2014.

Heard the learned counsel for the petitioner/A-1, the learned Public Prosecutor representing the respondent-State and perused the record.

The allegation against the petitioner herein is that he has purchased 23 kgs. of Ganja from A4. The learned counsel for petitioner would submit that the petitioner is an agriculturist and there is no other case against the petitioner except this case. This Court granted regular bail to A2 in Crl.P.No.9206 of 2021. 4.

Learned Public Prosecutor, on instructions, would submit that the Investigating Officer has completed investigation and F.S.L. report is awaited.

In view of the same, according to this Court the petitioner / A-1 is entitled for bail.

Therefore, the Criminal Petition is allowed and the petitioner/A-1 is directed to be released on bail, subject to the following terms and conditions:

(i) The petitioner/ A-1 shall be released on bail on his executing a personal bond to the tune of Rs.20,000/- (Rupees twenty thousands only) with two sureties for a like sum to the satisfaction of the Special Judicial First Class Magistrate (Prohibition and Excise Offences), Nalgonda.

(ii) That the petitioner/A-1 shall co-operate with the investigating agency.

(iii) That the petitioner/A-1 shall not misuse the liberty granted to him.

(iv) That the petitioner/A-1 shall appear before the Investigating Officer personally on every Sunday between 10.00 AM and 5.00 PM till completion of investigation and filing of final report.

As a sequel, miscellaneous petitions, if any, pending in the criminal petition shall stand closed.
