HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.25677 of 2018 ORDER:
Heard Mr.M.Suryanarayana for petitioner and the learned Assistant Government Pleader for Revenue.
The petitioner prays for the following relief :- " ...... to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in interfering the petitioner agricultural lands to an extent of Ac.3.99 cents in TRS No 3/ 3 of Raghavapuram Village, Chintalapudi Mandal, West Godavari District and trying to assume the petitioner land without following due process of law, where the appeal is pending before the 3rd respondent and also pendency of the writ petition before this Honourable Court is illegal, arbitrary and against the principles of natural justice and also violative of Articles 14, 19, 21 and 300A of Constitution of India and consequently direct the 4th respondent not to interfere with the peaceful possession and enjoyment of the petitioner lands in question ......" .
I have perused the material papers on record. Since the appeal is pending before the 3rd respondent, this Court is of the view that the ends of justice would be met by directing the 3rd respondent to dispose of the appeal within a reasonable period. Hence, the writ petition is disposed of by this order. (a) The petitioner is given liberty to file Memo before the 3rd respondent by enclosing a copy of this order within two weeks from
today and seek an early date for hearing of the appeal.
(b) On receiving memo, the 3rd respondent considers disposing of the appeal filed by petitioner, after hearing all the parties concerned, as expeditiously as possible, preferably within four months thereafter.
(c) Pending disposal of the appeal and communication of order, the possession of petitioner is not interfered with or disturbed. Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
