HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.14006 OF 2015 ORDER:

This criminal petition under section 438 of the Code of Criminal Procedure is filed by the petitioners-A.2 to A.5 seeking anticipatory bail in connection with F.I.R. No.139 of 2015 on the file of VI-Town Police Station, Nellore, registered for the offence under Sections 498-A, 307, 323 IPC and Sections 3 and 4 of Dowry Prohibition Act. The allegation against the petitioners herein is that demanding additional dowry, they harassed the de facto complainant physically and mentally.

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

This is a case arising out of matrimonial dispute. As far as the offence under Section 307 IPC is concerned, there is no serious allegation and that no serious injuries are attributed. Considering the above, this Court is inclined to grant anticipatory bail to the petitioners herein.

Hence, the petitioners-A.2 to A.5 are directed to surrender before the Magistrate concerned on or before 02.02.2016 and on such surrender, they shall be enlarged on bail on each of them executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety each for the likesum to the satisfaction of the Magistrate concerned. Further they are directed to report before the S.H.O. concerned as and when required.
