Heard learned Counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing Counsel for the respondentCorporation. The grievance of the petitioner in the present Writ Petition is that at the instance of his landlords, the respondent-authorities are trying to demolish the subject structures, without giving any notice.
On the other hand, it is submitted by the learned Standing Counsel that the respondent-Corporation will issue notice and proceed in accordance with law. It is further submitted by the learned Standing Counsel that the impugned constructions are in the surrendered portion.
Recording the said submission, the Writ Petition is disposed of, keeping it open for the respondent-Corporation to issue notice to the petitioner and call for the explanation and to pass final orders, strictly in accordance with law. It is also made clear that if no explanation is offered by the petitioner herein after receipt of the notice, this Order will not enure to the benefit of the petitioner herein. No coercive action with regard to the subject constructions shall be taken in the meanwhile.
