HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.24980 of 2003 ORDER :

When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation. The petitioner was challenging the orders of removal before the Industrial Tribunal and was seeking the relief to reinstate him by setting aside the orders of removal.

Since the petitioner has attained the age of superannuation, the relief of his reinstatement into service at this point of time, will not arise. However, this Court, having considered the above said facts, is of the considered view that this writ petition can be disposed of directing the respondents to pay service benefits to the petitioner for the service rendered by him for the period prior to his removal, within a period of four weeks from the date of receipt of a copy of this order, if not already paid.

With the above directions, the writ petition is disposed of. No order as to costs.
