HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition Nos. 38449 and 38842 of 2012 Common Order:

Since the issue involved in both the writ petitions is common in nature, they are being disposed of by this common order.

2. These two writ petitions are filed challenging the action of the respondents in issuing e-procurement tender notice as a third call for the works as the earlier bids in second call did not materialize.

3. When the matters are taken up for hearing, learned Government Pleader, on the basis of written instructions addressed by the Superintending Engineer (R&B) Circle, Guntur, to the Chief Engineer (R&B), Hyderabad, dated 24.02.2016, states that the third call tenders could not be taken up since the tender validities were already over and the works cannot be taken up with the same estimates and provision made therein since the road condition is very badly damaged and no major repairs are taken up. It was further stated that Kurnool - Guntur road was declared as National Highway as 544D and was handed over to National Highway Wing by the R & B Department.

4. In view of the same, the Writ Petitions have become infructuous. Accordingly, both the Writ Petitions are dismissed as infructuous. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous petitions, if any, pending in these Writ Petitions shall stand closed.
