THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO C.R.P.No.1469 OF 2015 O R D E R :

This civil revision petition is filed challenging the judgment dated 26.09.2014 in C.M.A.No.4 of 2012 on the file of the Senior Civil Judge, Kadiri confirming the order and decree dated 04.06.2012 passed by the learned Principal Junior Civil Judge, Kadiri in I.A.No.95 of 2011 in O.S.No.51 of 2011.

The petitioner herein is the defendant and the respondent herein is the plaintiff in the suit, which is filed for permanent injunction in respect of land to an extent of Ac.0.42 cents situated in Survey No.10352-B-2 of Gunjepalli Village, Kadiri within the limits of Mudigubba Grampanchayat of Anantapur District.

The order of temporary injunction has been in operation for the last three years and the suit itself is ripe for disposal. In the circumstances, this Court is not inclined to go into the merits of the concurrent orders passed by the Courts below. In the circumstances, the Principal Junior Civil Judge, Kadiri, is directed to dispose of O.S.No.51 of 2011 as expeditiously as possible, but not later than six months from the date of receipt of a copy of this order. The petitioner and the respondent shall cooperate for disposal of the suit. With the above directions, the civil revision petition is disposed of. There shall be no order as to costs.

Pending miscellaneous petitions in this revision petition, if any, shall stand closed in consequence.
