THE HON'BLE SRI JUSTI CE A.RAJASHEKER REDDY W .P.NO.1 8 6 2 OF 2 0 1 7

O R D E R

The petitioner in this writ petition is seeking for a direction to the 3rd respondent - Deputy Inspector General (Registration and Stamps), Guntur, A.P. to cause enquiry into the ownership in respect of the subject land and consequentially to cancel the registered sale deeds executed in favour of unofficial respondent No.5.

It is well settled that this court under the writ jurisdiction, cannot go into the disputed questions of fact. Under Section 31 of the Specific Relief Act, 1963, the petitioner has an alternate remedy to file a civil suit seeking cancellation of the sale deeds.

In view of the same, I am not inclined to entertain the writ petition. Leaving it open to the petitioner to avail the said alternate remedy, the writ petition is dismissed. No costs.

Miscellaneous petitions pending if any, shall stand closed. ---------------------------------------- A.RAJASHEKER REDDY,J DATE: 06-03-2017 AVS
