HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.23664 of 2017 ORDER:

The prayer in the writ petition reads as follows: "To issue a writ, order or direction, more particularly one in the nature of writ of mandamus declaring the action of the respondent Nos.3 and 4 in not permitting the petitioners to distribute the essential commodities to the ration card holders in their F.P. Shop at No.21 at D.No.3-32, Peddaveedu Village of the 1st petitioner, F.P.

Shop No.22 at D.No.5-116, Chitalammagudem H/o. Peddaveedu Village of the 2nd petitioner, F.P.Shop No.25 at D.No.1-32, Mattapally Village of the 3rd petitioner and F.P. Shop No.12 at D.No.147, Yatavakilla Village of the 4th petitioner all situated in Mattampally Mandal, Suryapet District on their valid authorization which is valid up to 31-03-2018 which is neither suspended nor cancelled and existing as on today as illegal, arbitrary and in violation of principles of natural justice and to pass such other order or orders." Heard the learned counsel for the petitioners and also learned Government Pleader for Civil Supplies representing respondents and perused the prayer in the writ petition with the supporting affidavit and other material on record. The learned Government Pleader submits that there are no any instructions of any disciplinary proceedings pending against the petitioners.

Having regard to the above and in the result, the Writ Petition is allowed directing the respondents to supply the essential commodities for distribution by the petitioners, for no disciplinary enquiry pending much less with any interim order.

Dr. SSRB,J Consequently, miscellaneous petitions, if any shall stand closed. No costs.
