THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 2715 OF 2017 O R D E R:

The petitioners claimed to be the owners of land in plot Nos. 11 and 12 though registered document Nos. 5861 and 5860 of 2004 dated 11-08-2003 registered in the office of Sri Balaji District Registrar Office, Tirupati, Chittoor District, and the petitioners have constructed residential house by obtaining permission from Municipal Corporation. It is stated that before obtaining permission, the petitioners verified and found that the land in survey No. 58 is not in the prohibited list for registration. In W.P.Nos. 9276 of 2014 and 32662 of 2015, it was held that the land in survey No. 58 is private land. It is also stated that the Commissioner, Endowments, issued proceedings dated 16-08-2010 stating that the land does not belong to Hathiramji Mutt and was sold to Tirumala Tirupati Devastanams.

When the Endowments Department had issued letter to the Registrar, Tirupati, stating that the land belongs to Hathiramji Mutt and not to register the land, the petitioners filed W.P.No. 8636 of 2015 seeking mandamus to register the property and the same was disposed on 21-01-2016 in the light of a Full Bench judgment of this Court in W.A.No. 343 of 2015 dated 23-12-2015. Thereafter, the petitioners approached the Commissioner, Endowments, and made a representation on 16-03-2016 requesting to delete the said survey number from the records of endowments. As no action has been taken, the present Writ Petition is filed.

In view of the above facts and circumstances, respondent No. 4 is directed to dispose of the representation dated 16-03-2016 and take action in accordance with law within a period of three months from the date of receipt of a copy of this order.
