HONOURABLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No. 2009 of 2018 ORDER:

Heard the learned counsel for the petitioner as well as the second respondent for the State.

The present criminal revision case is filed questing the docket order dated 27.06.2018 rejecting the memo filed by the complainant to amend the complaint, on the file of the Court of the Judicial Magistrate of First Class, Narsannapeta, Srikakulam District.

The brief facts of the case are that the petitioner filed a complaint vide C.C.No.12 of 2009 on the file of the Court of the Judicial Magistrate of First Class, Narsannapeta, Srikakulam District for the offences under Sections 420, 427, 468, 471 IPC against the first respondent. In the said calendar case, the complainant was examined in-chief, in part. At that stage, the petitioner filed memo on 20.06.2018 for amendment of the complaint. The learned Magistrate, after considering the memo, passed orders on 27.06.2018, rejecting the request of the petitioner. Aggrieved by the same, the present criminal revision case is filed. The learned counsel for the petitioner after arguing for some time, seeks permission of this Court to withdraw the criminal revision case with liberty to move an appropriate application for amendment of the complaint.

Acceding to the request of the learned counsel for the petitioner, the criminal revision case is dismissed giving liberty to him to move a fresh application seeking amendment of the complaint. On filing such application, the learned Magistrate is directed to consider the same and pass appropriate orders, as per law. The miscellaneous petitions, if any, pending in this criminal revision case shall stand closed.
