Heard the learned counsel for the petitioners, the learned Government Pleaders for Revenue, Panchayat Raj and Rural Development and the learned Standing Counsel for respondent No.5. With the consent of both parties the writ petition is disposed of at the admission stage.
The present writ petition is filed seeking issuance of Writ of Mandamus declaring the action of the respondents 1 to 5 in not restraining the respondent No.6 from proceeding further with the construction of a prayer hall in land admeasuring Ac.0-10 cents in R.S.No.59/14 situated at Appanaramuni Lanka Village, Sakinetipally Mandal, East Godavari District without obtaining permission from the competent authority, as illegal and arbitrary. At the time of hearing, the learned Standing Counsel for respondent No.5 stated that till date no construction is being done in the said land and no permission is granted for construction. Even the learned Government Pleader for Revenue on oral instructions stated that as on today, no construction is being made in the said land and no permission is also granted by the competent authority.
Recording the submissions made by the learned Standing Counsel for respondent No.6 and the learned Government Pleader for Revenue, the Writ Petition is closed making it clear that any constructions made there in shall be in accordance with law and if any constructions are made in violation of law, the respondents shall take appropriate action.
