THE HONOURABLE SRI JUSTICE K.SURENDER COMMON ORDER:

These Criminal Petitions are filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.1 and 3 in the event of their arrest in Crime No.346 of 2022 on the file of Adibatla Police Station, RangaReddy District registered for the offence punishable under Section 286 of IPC, Section 9(B)(1)(b) of Explosives Act, 1884 and Section 4 of the Prevention of Damage to Public Property Act, 1984 Act.

Heard learned counsel for petitioners/Accused Nos.1 and 3 and learned Assistant Public Prosecutor for respondent-State. Perused the record.

On receipt of information regarding some persons making holes to boulders without any permission from Government and filling with explosives in the boulders to blast at Sy.No.279 behind Sai Baba Temple JNNURM at

Ragannaguda revenue Village of Abdullapurmet Mandal of Ranga Reddy District, the police went to the spot. At that time, petitioners along with other accused were trying to cause blast in government land and the police caught hold of one person viz., Dhandugula Raju and seized certain blasting material from his possession and based on his confession petitioners were taken into custody. Pursuant to which, present petition has been filed.

The petitioners were arrayed as accused Nos.1 & 3. 5.

For the said reason of implicating the petitioners only on the basis of confession, the petitioners can be granted relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.1 & 3 shall be enlarged on bail in the event of their arrest subject to the following conditions:

i) The petitioners/Accused Nos.1 & 3 are directed to surrender before the Station House Officer, Adibatla Police Station within one week from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) The petitioners/Accused Nos.1 & 2 shall appear before the concerned Station House Officer, every Monday at 10.00 AM for a period of six weeks. iii) The petitioners/Accused Nos.1 & 3 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. 7.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
