THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2435 of 2015 ORDER:

This Criminal Revision Case is filed by the petitionercomplainant aggrieved by the order dated 07.08.2015 passed in Crl.A.No.125 of 2015 by the Principal Sessions Judge, Kurnool. The brief facts of the case are as follows:

The petitioner herein filed Crl.M.P.No.925 of 2015 in D.V.C.No.18 of 2014 before the Special Judicial Magistrate of First Class for Prohibition & Excise, Kurnool, seeking interim maintenance of Rs.40,000/- per month to her and her daughter. The trial Court, by order dated 18.06.2015, allowed the petition by granting interim maintenance at the rate of Rs.40,000/- per month to the petitioner herein and her daughter. Aggrieved by the same, the second respondent herein filed Criminal Appeal No.125 of 2015. The learned Principal Sessions Judge, Kurnool, modified the order passed by the learned Magistrate, by reducing the quantum of interim maintenance from Rs.40,000/- per month to Rs.20,000/- per month, pending disposal of main Domestic Violence Case. Hence, this Criminal Revision Case by the petitioner/complainant.

This Court heard the arguments and perused the records. Having regard to the facts and circumstances of the case and since DVC is pending before the trial Court, this Court does not find any ground to interfere with the order under revision. However, this revision is disposed of with the following directions: 1.

Since the second respondent has not preferred any revision before this Court, he is directed to comply with the order passed in the criminal appeal.

D.V.C.No.18 of 2014 is pending since one year and the same has already ripened for disposal and therefore, the trial Court is directed to dispose of the same as expeditiously as possible, preferably, within a period of six months from the date of receipt of a copy of this order, uninfluenced by the order passed by the first appellate Court or by this Court.
