HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner claimed to have participated in the selection as Trainee Assistant Engineer and though petitioner secured high merit and entitled to be appointed, he was not appointed on the ground that he produced Caste Certificate claiming as Scheduled Caste category, but he belongs to Backward Class. Even though explanation was filed by him in response to the show-cause notice dated 20.06.2017, so far no decision is made and petitioner is made to suffer without employment for no fault of him. 2.

During the course of hearing, learned counsel for petitioner also submits that in W.P.No.18807 of 2008 and batch, this Court held that as long as Caste Certificate issued to a person is not cancelled, employer cannot ignore the caste status claimed by candidate. However, said decision is not filed along with the explanation submitted by petitioner. 3.

At this stage, learned counsel for petitioner seeks leave of the Court to make a fresh representation enclosing copy of decision of this Court.

Granting such liberty, Writ Petition is disposed of. If petitioner makes a representation within one week from the date of receipt of copy of this order enclosing copy of judgment in W.P.No.18807 of 2008 and batch, 2nd and 3rd respondents are directed to consider the explanation offered by petitioner and the decision of this Court and pass appropriate orders as warranted by law within a period of four weeks from the date of receipt of such explanation. Pending miscellaneous petitions shall stand closed.
