HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 29435 of 2011 Order:

This Writ Petition was filed challenging the action of the respondents in insisting for payment of additional seigniorage fee in addition to the bid amount deposited for issuance of way bills in Form S-5 for conducting the sand quarry operations and transportation in Manthralayam Sand Reach, Manthralayam village and Mandal, Kurnool District, during the subsistence of lease period till 31.03.2013 pursuant to the lease agreement and work order in Proceedings No.4388/M4/2011, dated 28.05.2011, issued by the second respondent when Rule 9X(c) of AP minor Mineral Concession Rules, 1966 is struck down by the Division Bench of this Court vide judgment dated 22.04.2010.

2. This Court, by an order dated 03.11.2011, granted interim direction pending further orders in the Writ Petition. Subsequently, the period of lease itself is expired. In view of the same, nothing survives for consideration in the present Writ Petition.

3. The Writ Petition is, accordingly, dismissed as infructuous. However, if the parties, the petitioner or the respondents, have any subsisting grievance, they can take appropriate proceedings in accordance with law. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
