HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38772 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to quash the proceedings against them in FIR No.204 of 2013 on the file of the Central Crime Station, Hyderabad. 2.
Heard and perused the material available on record. 3.
It is alleged that the 1st petitioner had development agreement with Sardhar Singh, Satpal Singh and three others in respect of subject land to construct independent villas and that the 7th respondent claimed to have purchased one villa and paid Rs.80 lakhs to the 1st petitioner on various dates and requested to register villa in his name on payment of balance of Rs.4,00,000/-. The 1st petitioner did not register the villa as agreed, whereas it is the grievance of the petitioners that if the 7th respondent had any grievance for non-registration of villa in his favour, he ought to have approached the civil court and that the allegations are purely civil in nature.

The petitioners filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation in the above crime. However, considering the grievance of the petitioners, without expressing any opinion on merits, the official respondents are directed to complete the investigation and file a final report, in accordance with law, without arresting the petitioners. The petitioners are directed to appear before the Station House Officer concerned as and when required and they are also directed to execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety each for the like sum each to the satisfaction of the Station
House Officer concerned, as surety for their future appearance as and required.
