HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner claims that she purchased the land to an extent of Ac.0.26 guntas in Sy.No.47 of Vastha Kondur village, Gundala Mandal, Yadadri Bhongir District, by way of registered sale deed dated 12.01.2017. She submitted representation for mutating her name based on sale deed executed in her favour on 02.12.2019. Alleging inaction on the said representation, this Writ Petition is filed. 2.

Two aspects are noticed; firstly petitioner has not submitted application as required by the provisions of the Telangana Rights in Land and Pattadar passbooks Act, 1971 and the Rules made there under requesting to mutate the name of petitioner by claiming passing of title as per the registered sale deed and secondly, if the representation can be treated as application, it was made only on 02.12.2019 and the Writ Petition is filed on 30.12.2019. It cannot be said that Tahsildar is required to act upon on the said representation expeditiously and by not acting within four weeks, it cannot be said that there is inordinate delay in considering the application necessitating the petitioner to invoke jurisdiction of this Court under Article 226 of the Constitution of India.

Writ Petition is dismissed leaving it open to petitioner to make an application in the prescribed form for mutation of her name in the revenue records, and as and when such application is filed, the same shall be considered and appropriate orders be passed within a period of six weeks from the date of receipt of such application. Pending miscellaneous petitions shall stand closed.
