HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.29240 of 2019 ORDER:

Heard Sri B.Shiva Kumar, learned counsel for the petitioner and the learned Government Pleader for Services-II. With the consent of both the parties, this writ petition is disposed of at the admission stage.

This writ petition is filed seeking the following relief :- "...............writ Of mandamus or any other appropriate writ; declaring the action of the 2nd & 3rd Respondents for not considering the petitioner case for the post of Typist, Junior Technical Officer and Tracer as per the notification issued by the 3rd Respondent inspite petitioner having all qualification including disability certificate of 61% issued by the Superintendent, District Headquarters Hospital, Nalgonda is illegal arbitrary and unjust and violation of Article 21 of Constitution of India consequently direct 2nd and 3rd Respondents to send the petitioner for Re-assessment verification of disability and consider the petitioner case for the post of Typist, Junior Technical Officer and Tracer and pass such other order..............."

It has been contended by the petitioner that she is a disabled person suffering with 61% disability and she has responded to the notification issued by the 3rd respondent for recruitment of backlog vacancies reserved for disabled persons for the year 2018-19 under Physically Handicapped (H.H) category for the posts of Typist, Junior Technical Officer (JTO), Tracer and Fishermen, as she is eligible for the above said posts. The grievance of the petitioner is that her case was not considered for the above said posts inspite of the fact that she comes within the

zone of consideration. Petitioner further contends that she had submitted a representation on 02.12.2019 requesting the respondents to consider her case for appointment to the post of Typist, Junior Technical Officer (JTO), Tracer. But so far, the respondents have not passed any orders on the said representation.

Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner on 02.12.2019 and pass appropriate orders within reasonable period. Learned Government Pleader appearing for the respondents contends that since the petitioner's representation is pending with the respondents, the respondents would consider the same and pass appropriate orders in accordance with law. This Court, having considered the rival submissions of the learned counsel appearing for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 02.12.2019 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, this writ petition is disposed of. No order as to costs.
