Heard learned counsel for the petitioner, learned Government Pleader for Mines and Geology appearing for respondent Nos.1 to 3 and Sri V.V.N.Narayan Rao, learned counsel appearing for the fourth, apart from perusing the material on record.
Show cause notice, dated 24.04.2018, issued by the Director of Mines and Geology, Hyderabad-second respondent herein, is under challenge in the present Writ Petition. Consequent upon the final orders in a revision application, filed by the fourth respondent herein, setting aside the orders of the State Government, vide Memo No.6911/M1(2)/2006-3, dated 15.05.2007, and, basing on the request of the Assistant Director of Mines and Geology, Ranga Reddy District-third respondent herein, the Director of Mines and Geology, Hyderabad-second respondent herein issued a show cause notice, bearing No.3670/R2-1/2018, dated 24.04.2018, calling upon the petitioner herein to show cause as to why the application of the petitioner herein should not be rejected, under Rule 12 (5) (d) of the Telangana State Minor Mineral Concession Rules, 1966 (for brevity, 'the Rules').
It is submitted by the learned counsel for the petitioner that, responding to the said show cause notice, dated
24.04.2018, petitioner herein submitted an explanation on 21.05.2018 and the same is pending consideration before the second respondent herein. Though so many contentions have been urged in the affidavit, filed in support of the Writ Petition, as the impugned notice, in the present case, is only a show cause notice, issued under Rule 12 (5) (d) of the Rules, and, as the petitioner herein already submitted its explanation on 21.05.2018, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the Director of Mines and Geology, Hyderabad-second respondent herein to take further action, pursuant to the show cause notice, dated 24.04.2018, after considering the explanation, dated 21.05.2018, if the issue is pending, as on date, before the second respondent.
Accordingly, Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
