HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CIVIL REVISION PETITION No.222 of 2015 ORDER : (per Hon'ble Sri Justice R.Subhash Reddy) This Civil Revision Petition, under Section 115 of the Code of Civil Procedure, is filed by the petitioner/judgment debtor No.1 aggrieved by the order dated 28.08.2014 in E.P.No.1 of 2014 passed by the IX Additional District Judge, Wanaparthy, Mahabubnagar District.

2. When the matter is called for hearing, it is submitted by the learned counsel for respondent No.1/decree holder that E.P.No.1 of 2014 was dismissed for default and that the dispute between the parties is likely to be settled.

3. In view of the said submission, as E.P.No.1 of 2014 is already dismissed for non-prosecution, the cause in this civil revision petition has become infructuous.

4. Accordingly, this civil revision petition is dismissed as infructuous. However, liberty is given to the petitioner/judgment debtor No.1 to pursue the remedies available under law. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
